General terms and conditions for orders placed on themask.ch. Last updated: 1 October 2026

01 — Scope and seller

These terms apply to all orders placed in the online shop themask.ch ("THE MASK"). Your contract is with themask.ch (Mattia Vinci, sole proprietorship), Rue du Pilate 5, 2502 Biel/Bienne, email support.themask@gmail.com, WhatsApp +41 78 441 58 16 ("we").

The shop is intended for private customers with a delivery address in Switzerland. Orders may be placed by adults; minors may only order with the consent of their legal guardian.

02 — Ordering and conclusion of the contract

The products shown in the shop are not a binding offer but an invitation to order. Ordering works in these steps (Art. 3 para. 1 let. s UCA):

  1. Choose the face and quantity and add them to the cart.
  2. Open the checkout from the cart.
  3. Enter your contact details and delivery address, then choose the shipping method and payment method.
  4. Check all details in the summary. Until you submit, you can correct any input error directly in the fields or in the cart.
  5. By clicking "Pay now", you place a binding order.

We confirm receipt of your order by email straight away. The contract is concluded with this order confirmation. If, exceptionally, we cannot deliver, we will inform you without delay and refund any amounts already paid within 14 days.

03 — Prices

All prices are final prices in Swiss francs (CHF) in accordance with the Price Indication Ordinance (PIO). We are not registered for VAT; no VAT is charged.

Delivery within Switzerland is always free, with no minimum order. The Squad Pack discount (2 masks 10% off, 3 masks 20% off, 4 or more masks 25% off) is applied automatically to the current price in the cart. The price at the time of ordering applies.

04 — Payment

You pay at checkout by card (Visa, Mastercard) or TWINT. Payment is processed by the relevant payment provider. We do not receive or store your full card details. The amount is charged when you order.

05 — Delivery

We deliver within Switzerland. We ship your order within 24 hours (Mon–Fri), with tracking. The masks are made in China and shipped directly from our production partner's warehouse. The stated total delivery time of 8–13 days from your order is an estimate based on previous shipments, not a guaranteed date. Orders with several masks may arrive in separate parcels.

If the goods have not arrived seven days after the stated delivery time has passed, we will let you know and you can choose: keep waiting, or withdraw from the contract and receive a full refund within 14 days. Your rights under Art. 102 et seq. of the Swiss Code of Obligations (CO) are reserved.

By way of derogation from Art. 185 CO, we bear the risk of loss and damage until the parcel is delivered to you. If a parcel is lost, we will reship it free of charge or refund the amount paid.

06 — Import charges

On import into Switzerland, the Federal Office for Customs and Border Security (FOCBS) levies import VAT if the amount exceeds CHF 5, which is the case from a goods value of about CHF 62; at our prices, this generally only affects orders of four or more masks. The carrier may charge an additional fee for this. These costs are borne by you; we point this out in the cart.

07 — Returns (voluntary)

Swiss law provides no statutory right of withdrawal for online purchases; Art. 40a et seq. CO do not apply to orders placed online. We voluntarily offer a 14-day return right from receipt for unworn masks in their original packaging. The details are set out in our returns policy. This offer adds to your statutory rights and does not limit them.

Sale items cannot be returned or exchanged and are not refunded. A sale item is one expressly marked in the shop as on sale or at a reduced price; the Squad Pack volume discount does not count. If a sale item is defective, wrong or never arrives, we still replace or refund it; your statutory warranty rights (section 08) are unaffected.

08 — Warranty

The statutory warranty under Art. 197 et seq. CO applies. The warranty period is two years from delivery (Art. 210 CO). Please check the goods on receipt and report any defect as soon as you discover it, ideally with a photo sent to support.themask@gmail.com (Art. 201 CO).

If a product is defective, we will send a free replacement or refund the purchase price, as you prefer. Further statutory claims are reserved. The following are not defects: normal wear, damage caused by improper care (for example a tumble dryer or an iron), and slight variations in colour or print position caused by the stretch of the fabric and the seams.

09 — Product, images and use

The product images are for illustrative purposes and show the print. They may differ slightly from the product delivered, particularly in colour and detail.

The masks are accessories for winter sports and cold weather. They are not personal protective equipment and replace neither a helmet nor goggles. Please follow the safety notes on the product page and the ban on face coverings in public spaces that has applied in Switzerland since 1 January 2025.

10 — Liability

We accept unlimited liability for damage caused intentionally or through gross negligence, for personal injury and under the Product Liability Act (PLA). Otherwise, our liability for slight negligence is limited, to the extent permitted by law, to direct damage up to the value of the order (Art. 100 CO).

11 — Data protection

12 — Content

The texts, images and design of this shop, as well as the names of the faces, may not be used commercially without our consent.

13 — Changes

Your order is governed by the version of these terms published at the time you placed it.

14 — Governing law and jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). As a consumer, you may bring proceedings before the court at your place of residence or at our registered office; proceedings against you must be brought before the court at your place of residence (Art. 32 Swiss Civil Procedure Code). Otherwise, the place of jurisdiction is Biel/Bienne.

15 — Language versions

These terms are available in German, French, Italian and English. In case of discrepancies, the German version prevails.
